W. David Campagne

Attorney Biography


Dave Campagne is a shareholder in the law firm and practices in the San Francisco office. He represents insurers in disputes with insureds concerning environmental and toxic tort liabilities.

Mr. Campagne earned his B.A. from the University of Colorado at Boulder in 1979, and his J.D. from Hastings College of the Law in 1983. He has been admitted to the California State Bar since 1983, and has appeared in state and federal courts throughout many of the western United States at both the trial and appellate levels.

Upon being admitted, Mr. Campagne first worked on what became a three-year series of phased trial proceedings, designated In Re Coordinated Asbestos Coverage Cases. That case, styled Armstrong World Industries v. Aetna Casualty & Surety on appeal, was the first complex insurance coverage/toxic tort case to be tried to conclusion in California.

In 1986, Mr. Campagne was a key member of the nationally prominent group of defense lawyers that successfully tried Shell Oil Co. v. Winterthur Ins. Co., the first major environmental coverage case to be litigated to conclusion in California. The rules of law generated by Armstrong and Shell comprised the analytical framework for much of the complex coverage litigation that unfolded in California over the next two decades.

In 1995, Mr. Campagne became a partner at Buchalter, Nemer, Fields & Younger. At that firm, he was the lead attorney for several insurers in FMC Corp. v. Plaisted & Cos.through successive trial phases, after which his clients settled on favorable terms. In 1996, Mr. Campagne joined several of his former Buchalter colleagues at what is now Sinnott, Puebla, Campagne & Curet, APLC, where he opened and managed the San Francisco office.

Since joining the firm, Mr. Campagne has led a practice group specializing in all aspects of environmental liability coverage. This includes both claim counseling and litigation in connection with a broad range of historical placements and new insurance products. He frequently serves as liaison counsel in litigated matters, and routinely assists clients in achieving negotiated resolution of disputed claims.

Mr. Campagne has lectured on a number of coverage-related topics, including loss allocation, various pollution exclusions, non-fortuitous loss, and complex case management. He has written several articles for national and international trade publications on many of the same subjects. He has received the highest rating (AV) from his peers, and was listed in Who’s Who Legal: California in 2008 and 2009.
