Richard Johnson

Attorney Biography

For over 25 years, Richard has represented insurers in complex coverage and litigation matters. His practice involves Directors & Officers Liability, Professional Liability, Errors and Omissions, Employment Practices Liability, and Fiduciary Liability coverages. Richard also has extensive experience with environmental, mass tort, business interruption, data breach, and event cancellation coverages.

Richard’s practice is nationwide, and he has handled litigation in state and federal courts around the United States, including jury trials and bench trials, and numerous appeals in federal and state appellate courts in cases involving securities law and insurance issues, as well as arbitrations and mediations of complex coverage disputes.

Several of the cases he briefed have resulted in groundbreaking decisions on significant coverage issues, including rescission, the use of statutory interpleader, apportionment of coverages between carriers and policies, legal insurability of restitution/disgorgement, and “bad faith.”

In addition to domestic coverage matters, Richard has also handled cases for Bermuda and London carriers, as well as coverage disputes under English and Hong Kong law. He has also been involved in the drafting of policy language and was recently asked to provide guidance to London carriers in connection with the drafting and interpretation of pandemic exclusions for business interruption and event cancellation coverages.

A longtime member of the Tort Trial & Insurance Practice Section of the American Bar Association, Richard has served as a Vice-Chair in the Professionals Officers and Directors Liability Committee and the Corporate Governance Task Force.

Richard has written several articles on insurance issues, and spoken to various audiences including lawyers, brokers, claims handlers, underwriters, and Insureds on current topics in insurance law throughout the United States.
